Terms of Service

1. Acceptance of Terms

By accessing or using ImageChef ("the Service"), operated by The Zack Greenfield Company ("ZGC", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ImageChef is an AI-powered food photography enhancement service. You upload food photos, select styling options, and receive professionally enhanced images generated by artificial intelligence. The Service is available at app.imagechef.ai and as a progressive web application.

3. Accounts and Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payment

• Free Trial: New accounts include a 14-day free trial. You will not be charged during the trial period.
• Billing: Subscriptions are billed monthly. Payment is processed by Kartra on behalf of ZGC.
• Cancellation: You may cancel at any time. Access continues until the end of your current billing period. No partial refunds for unused time.
• Generation Limits: Each plan includes a monthly generation allowance. Unused generations do not roll over.

5. Acceptable Use

You agree NOT to:

• Upload images that violate any laws or third-party rights
• Use the Service to generate misleading or deceptive content
• Attempt to reverse-engineer, copy, or redistribute the AI models or technology
• Use automated scripts or bots to access the Service
• Resell or sublicense access to the Service without written permission
• Upload content that is obscene, illegal, or harmful

6. Intellectual Property

• Your Content: You retain all rights to the original photos you upload. You grant us a limited license to process your images through our AI pipeline for the sole purpose of providing the Service.
• Generated Images: You own the AI-generated output images created from your uploads. You may use them for any lawful commercial or personal purpose.
• Our IP: The ImageChef name, logo, software, AI models, and website design are the property of ZGC. You may not copy, modify, or distribute any part of our Service.
• Free Trial Watermarks: Images generated during a free trial or demo may contain watermarks. Watermarks are removed for paid subscribers.

7. AI-Generated Content Disclaimer

ImageChef uses artificial intelligence to enhance food photographs. While we strive for accuracy, AI-generated images may occasionally differ from the original dish in minor ways. You are responsible for reviewing generated images before publishing them. We recommend verifying that generated images accurately represent your food offerings.

8. Availability and Uptime

We aim to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

9. Data Processing

Your uploaded images are processed using Google's Generative AI services. By using ImageChef, you consent to your images being sent to Google's API for AI processing. See our Privacy Policy for full details on data handling.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZGC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ZGC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

13. Modifications

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
